1. Acceptance of Terms

Saturday (https://saturdayexp.com) website (“Website/App”) is a nightlife ecosystem platform, owned and operated by Jane Margolis PLC, a company registered under the governance of INDIA. Through this website, Jane Margolis PLC offers users (“User”) access to information, pricing, availability, ticket reservations, nightlife experiences, and table reservations for venues across urban areas throughout INDIA.

This User Agreement (“Agreement”) outlines the terms and conditions under which Jane Margolis PLC provides the services through the website. By accessing and using the website, Users agree to all terms, conditions, and notices contained in this Agreement, as may be updated on the website from time to time. The use of the website constitutes the User’s acknowledgment and acceptance of this Agreement. If a User does not agree with any part of these terms, conditions, and notices, they should not use the website.

Furthermore, Organisers/Host may impose additional terms and guidelines that govern specific features, offers, or operational rules and policies. Users are responsible for adhering to these terms and guidelines or operational rules and policies of the Organisers/Host they choose to interact with, including the terms and conditions set by the Organisers/Host. In case of any conflict between the terms, conditions, and notices in this Agreement and the additional terms and guidelines provided by the Organisers/Host, the latter will take precedence.

If any provision of this Agreement be deemed invalid or unenforceable, whether in whole or in part, such invalidity or unenforceability shall be limited solely to that provision or portion thereof. The remainder of the provision and all other provisions of this Agreement shall remain valid and enforceable to the fullest extent permitted by law.

2. Access and Use

2.1. The User represents and warrants that they are of legal age to enter into a binding contract and are not prohibited from using the website or receiving the services under applicable laws.

To access the services, the User must possess and maintain, at their own expense, all necessary equipment including a computer and modem, and maintain access to the Internet. The User is responsible for any third-party fees associated with accessing the services, such as airtime or internet Organiser/Host charges.

The User acknowledges that the services may include communications from Jane Margolis PLC regarding service announcements and administrative messages. The User agrees that the services are provided “as is,” and Jane Margolis PLC assumes no responsibility for the deletion, misdelivery, or failure to store any user communications or personalized settings.

User registration on the website is optional. If the User chooses to register, they will receive a user ID and token upon completion of the registration process. The User agrees to maintain the confidentiality of their token and user ID and to be fully responsible for all activities conducted using their token or user ID. The User agrees not to use another party’s user ID and password without proper authorization.

The User also undertakes to immediately inform Jane Margolis PLC of any unauthorized use of their password or user ID and to log off at the end of each session on the website. Jane Margolis PLC shall not be liable for any loss or damage resulting from the User’s failure to comply with this requirement.

2.2. The User agrees not to engage in the sale, trade, or exploitation of any portion of the service for commercial purposes. It is expressly stated that the website is intended solely for personal use and not for commercial purposes.

2.3. The User agrees not to engage in reverse engineering, modification, copying, distribution, transmission, display, performance, reproduction, publication, licensing, creation of derivative works, transfer, or sale of any information, software, products, or services obtained from the website. It is emphasized that wholesale reproduction, copying of content for commercial or non-commercial purposes, and unauthorized modification of data and information within the website’s content are strictly prohibited.

2.4. The website offers various communication services, such as in-built chat, social media handles, contact number, personal web pages. The User agrees to utilize these communication services solely for posting, sending, and receiving messages and materials that are appropriate and relevant to the specific communication service. For instance, when using a communication service, the User agrees not to engage in activities such as defamation, abuse, harassment, stalking, threats, or any other actions that violate the legal rights of others.

The User agrees not to upload files containing software or other materials protected by intellectual property laws unless they own or control the rights.

The User also agrees not to upload or distribute files containing viruses, corrupted files, or any other harmful software that may disrupt the operation of the website or another user’s computer.

The User agrees not to use communication services for purposes such as advertising, conducting surveys, contests, pyramid schemes, chain letters, or any other business-related activities.

While Jane Margolis PLC is not obligated to monitor communication services, it reserves the right to review materials posted through these services and remove any materials at its discretion. Jane Margolis PLC also reserves the right to terminate a User’s access to communication services without notice for any reason.

Jane Margolis PLC may disclose any necessary information to comply with applicable laws, regulations, legal processes, or governmental requests, and it reserves the right to edit, refuse to post, or remove any information or materials at its discretion.

Jane Margolis PLC does not endorse or control the content, messages, or information found in any communication service, and therefore disclaims any liability or responsibility with regard to communication services and any actions resulting from a User’s participation in them.

2.5. The User agrees not to engage in any activities that violate applicable laws within or outside INDIA, or contravene the terms outlined in this Agreement, whether explicitly stated or implied. Additionally, the User shall refrain from using the website in a manner that may disrupt, impair, or burden its functionality, or interfere with others’ ability to use and enjoy the website. The User also pledges not to acquire or attempt to acquire any materials or information through unauthorized means not provided or intended for by the website.

3. Amendments of Terms

Jane Margolis PLC retains the right to modify the terms, conditions, and notices that apply to the services provided via the website, which includes but is not limited to, any charges for these services. Users are responsible for periodically checking these terms and conditions for any updates.

Notices, including those regarding changes to the terms and conditions, shall be in written form, in English. For registered Users, notices should be sent to the email address specified in the registration form.

4. Privacy Policy

The User acknowledges and agrees that they have read and fully understood Jane Margolis PLC‘s Privacy Policy regarding the website. The User also consents to and accepts the terms and contents of the Privacy Policy.

5. Liability

Jane Margolis PLC strives to ensure the accuracy of all information on the website; however, Jane Margolis PLC neither guarantees nor makes any representations regarding the quality, accuracy, or completeness of any data or information provided. Jane Margolis PLC disclaims all warranties, express or implied, regarding the website and its contents, including warranties of fitness for a particular purpose and merchantability. Jane Margolis PLC shall not be liable for any loss, whether direct or consequential, arising from the use of the information contained on the website.

As Jane Margolis PLC acts solely as a booking agent, it bears no liability for any aspect of the arrangements between the Organiser/Host and the user regarding the standards of services provided. Jane Margolis PLC shall not be liable for the services provided by the Organiser/Host under any circumstances.

While Jane Margolis PLC makes reasonable efforts to ensure the accuracy of the descriptions and content on the website, it does not assume responsibility for changes resulting from human or data entry errors, or for any loss or damages suffered by users due to such information. Jane Margolis PLC does not endorse any advertiser on its website, and users are encouraged to verify the accuracy of all information before relying on it.

In no event shall Jane Margolis PLC be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising from the use or inability to use the services, including but not limited to loss of use, data, or profits. Jane Margolis PLC shall not be responsible for delays or interruptions in website access due to maintenance operations or technical reasons beyond its control.

These limitations, disclaimer of warranties, and exclusions apply to the fullest extent permitted by applicable law. Jane Margolis PLC’s maximum liability under any circumstances regarding services offered on the site shall be limited to the refund of the total amount received from the customer for availing the services, minus any applicable cancellation or refund charges. In no event shall Jane Margolis PLC‘s liability include any consequential loss, damage, or additional expense whatsoever.

6. Intellectual Proprietary Rights

Jane Margolis PLC or Organisers/Host may provide the User with content such as photographs, graphics, video, or other materials contained in sponsor advertisements or information. This material may be protected by copyrights, trademarks, or other intellectual property rights and laws. The User may only use this material as expressly authorized by Jane Margolis PLC or Organisers/Host and shall not copy, transmit, or create derivative works of such material without express authorization.

7. Payments

The User is responsible for paying all relevant charges, fees, duties, taxes, levies, and assessments associated with availing Jane Margolis PLC services.

In case of event cancellation from Organiser/Host, Jane Margolis PLC would issue refunds only if payouts have not been released to the Organiser/Host before the cancellation was communicated.

8. Breach of Agreement

(a) The User breaches this agreement or any documents referenced herein;
(b) Jane Margolis PLC is unable to verify or authenticate any information provided by the User; or
(c) Jane Margolis PLC believes that the User’s actions may infringe on

Such actions may include limiting the User’s activity, terminating the User’s listing, warning other users about the User’s actions, temporarily or indefinitely suspending or terminating the User’s registration, and/or denying the User access to the website.

Jane Margolis PLC may, at its sole discretion, reinstate suspended users. However, once a user has been indefinitely suspended, they may not attempt to register with Jane Margolis PLC or use the website until reinstated by Jane Margolis PLC.

Despite the above, if the User breaches this agreement or any referenced documents, Jane Margolis PLC reserves the right to recover any outstanding amounts owed and to take appropriate legal action as deemed necessary.

9. Governance Laws

This agreement shall be interpreted and enforced in accordance with the laws of INDIA, disregarding any conflict of laws principles. Any disputes arising from or related to this agreement shall be exclusively adjudicated by the court of New Delhi, INDIA.
